These Terms of Service ("Terms") govern your use of the Mafilika Holdings & Innovation website and any services provided by Mafilika Holdings & Innovation ("we", "us", "our"). By engaging our services or using our website, you agree to these Terms.
We provide website design and development, AI automation, search engine optimisation, social media marketing, lead generation systems and related digital services. The specific scope, deliverables and timeline for any project are set out in a written proposal or quote agreed with the client before work begins.
All pricing on our website is indicative. A final, itemised quote is issued following a strategy session and is valid for the period stated on the proposal. Work begins only once a proposal has been accepted and any required deposit received.
Once-off projects are typically billed as a deposit followed by milestone payments, as outlined in your proposal. Ongoing services (hosting, SEO, automation, marketing) are billed monthly in advance unless otherwise agreed in writing.
Clients are responsible for providing timely feedback, content, brand assets and access to any accounts required to complete the project. Delays in providing these may extend agreed timelines.
Upon full payment, ownership of the final website design and custom content produced for the client transfers to the client. Mafilika Holdings & Innovation retains the right to showcase completed work in its own portfolio and marketing materials, unless otherwise agreed in writing.
Some services rely on third-party platforms (hosting providers, WhatsApp Business, CRM tools, advertising platforms). We are not responsible for outages, policy changes or fees imposed directly by these third parties.
Where a monthly support or marketing retainer is in place, services included are as detailed in your proposal. Retainers may be paused or cancelled with the notice period specified in your agreement.
While we apply industry best practice to every project, search engine rankings, lead volumes and sales outcomes depend on factors outside our direct control, including market conditions and competitor activity. Any specific guarantee applicable to a package will be stated explicitly in your proposal.
To the extent permitted by law, Mafilika Holdings & Innovation shall not be liable for indirect, incidental or consequential loss arising from the use of our services or website.
Either party may terminate an ongoing services agreement in accordance with the notice period stated in the relevant proposal. Once-off project agreements may be terminated prior to completion subject to payment for work already completed.
These Terms are governed by the laws of the Republic of South Africa.
